Clean Break Orders: Ending Financial Ties After Divorce
Going through a divorce is tough enough without worrying about the future. Many people believe that once the divorce is final, everything – marriage, money and obligations – is neatly tied up. But that is not always the reality. Unless you have a legal financial settlement in place, your ex could still make financial claims against you down the line, even years later.
That’s where a clean break order would come in.
What is a clean break order?
Put simply, it is a court order that cuts financial ties between you and your ex. Once it is approved, neither of you are able to make claims against the other’s money, property or future income. It is a way of drawing a line under things so that you are both able to move on without the worry of looking over your shoulder.
Why It Matters
You might be thinking: ‘We don’t have that much to split; what is the point?’ But life changes very quickly. One of you might inherit money, start a successful business or build savings in the future. Without a clean break order, these assets could still be up for grabs, and your ex could still make claims against you. Having one in place gives you security and certainty.
How do you get one?
You and your ex can agree on the terms, and a solicitor will be able to draft the order for you. It then needs to be approved by a judge. In most cases, there’s no need for a court hearing – it is a straightforward process, but ultimately an important one.
